PRIVACY NOTICE
This is a draft for the intended production service. Before launch it must be updated with actual providers, processing locations, retention periods, verified security controls and a designated privacy contact.
Who operates the service
The Energy Storage Company is operated by Exergist Innovations Inc. A monitored privacy contact must be designated before a private account service launches.
This local calculator
The current calculator processes form entries and selected CSV files on your device. It does not submit that project data to an account or application server. The site remembers your entry choice for the current browser session. JSON and CSV reports are saved on your device only if you choose to download them. Normal website delivery may involve hosting access logs; the production notice must identify its actual provider and retention period.
What information is involved
When the full service is available, you may choose to provide account details, energy project or technology specifications, location, uploaded material, assumptions, saved scenarios, report details and support requests. We would also hold the minimum consent, access and security records needed to operate and protect the service. Please do not supply personal records or confidential material belonging to others unless you have authority to share them.
Why it is used
Information is used to prepare and save the analysis you request, maintain account access, answer support requests, protect the service and meet applicable obligations. Optional AI assistance may help organize a description or explain a frozen result. Core financial calculations will be performed by reproducible software, not by AI. Marketing contact and disclosure of a project to a lender, OEM or VanadiumBank require separate permission.
Who may access it
Authorized personnel and necessary providers for hosting, authentication, storage, security, reporting and optional AI assistance may process relevant information. We do not intend to publish or sell project submissions. We would share a particular scenario with a named commercial partner only after a distinct affirmative choice, or if disclosure is required by law. The final notice will identify provider categories, locations and any international processing more specifically.
Security and remaining risk
The production design requires encrypted connections and storage, limited access, audit records and two factor authentication for private accounts. These are requirements, not a claim that the controls are already deployed in this preview. No online service can eliminate the possibility of a cyber incident. If an incident occurs, we will investigate and provide any notices required by applicable law.
Retention and your choices
Information should be kept only as long as needed for the purpose for which it was provided, for saved work and for applicable legal obligations. The final service must publish a specific retention and deletion schedule. You may ask to access, correct, export or delete information, or withdraw optional consent, subject to applicable limits.
Your original material
You retain rights in the original material you submit. The service needs permission to process it for the analysis you request. Exergist Innovations Inc. owns the platform and its own methods. Any broader commercial use or transfer of rights in a confidential opportunity requires clear, separate terms.
TERMS AND RISK
Nature of the analysis
Outputs are scenario estimates. They are not a guarantee of technology performance, a confirmed tariff or incentive, investment advice, an offer to finance, or lender approval. Important engineering, market and commercial inputs must be independently verified before a project commitment.
Cybersecurity and responsibility
The intended production service must use reasonable technical and organizational safeguards to protect submitted information. No online system can guarantee that unauthorized access, loss or disclosure will never occur. To the extent permitted by applicable law, we are not liable for loss resulting from a cyber incident beyond our reasonable control where we have met our legal and contractual obligations. Nothing in these Terms excludes liability or privacy duties that applicable law does not allow us to exclude. We will assess an incident and give any legally required notice.
This clause is a draft. Counsel must review the final Terms, liability limitations and governing law before real information is collected.
